Your Basic Website – The Fine Print
For the purposes of these terms and conditions, Eye Dropper Designs is hereafter referred to as ‘Consultant’, and the person/ representative of a person/ business who has registered for the Basic Website Package is hereafter referred to as ‘Client’.
Whereas, Consultant is a professional website designer and developer of good standing; Whereas, Client wishes Consultant to create certain Work described more fully herein; and Whereas, Consultant wishes to create such Work; Now, therefore, in consideration of the foregoing premises and the mutual covenants hereinafter set forth and other valuable considerations, the parties hereto agree as follows:

Website Design & Development For The Basic Website Package
Designed & Layout
The Basic Website Package is aimed at keeping costs low, as such you can only select a design / layout from the available selections presented to you at the time of signing up. There will be an ability to modify these designs to suit your business colour scheme, however the overall functionality of the website can not be altered within the scope of your package.
Additional modifications may be made to the functionality of your website at an additional cost. This is not included in the standard price for the Basic Website Package.
Number of Pages
The Basic Website Package is limited to 3 pages only within the standard pricing option. These pages include the ‘Home’ page, ‘Products/ Services’ page and a ‘Contact’ page.
Additional pages may be added at your request for an additional cost. This is not included in the standard price for the Basic Website Package.
About You & Your Business
Your Personal Information
You are required to provide your personal information for invoicing purposes. All information you provide is kept private and confidential unless you give permission otherwise.
Your Business Information
Your business information, such as contact details, location and ABN/ ACN is required for the purpose of invoicing, registering domain name/ hosting accounts and to provide contact information on your website.
Domain Name, Website Hosting & Email Accounts
Client supplied hosting accounts
If you are hosting your website on an independent hosting account, you are required to provide access either by way of FTP Credentials or CPanel / Plesk credentials.
Included hosting accounts
The Basic Website package includes the first 12 months domain name and website hosting for free. You will then be required to pay for additional hosting charges – yearly for website hosting and biannually for domain name hosting.
You will be invoiced automatically approximately 4 weeks prior to your renewal date. If your invoice is not paid, your hosting will not be renewed and your hosting package will be removed from the server. Eye Dropper Designs will not be held accountable for any loss of data or interruption to business as a result.
If you wish to transfer your domain name or website hosting to an alternative provider, you must arrange to do so, and ensure the transfer is completed before the expiration date of your hosting account(s). Eye Dropper Designs can assist with this at an additional cost.
Your Ideal Domain Name
Your domain name is your unique website address, such as ‘www.example.com.au’. If your desired domain name is unavailable, we will work with you to find a suitable alternative, subject to availability.
Please note, in order to register a ‘.com.au’ domain name (or any domain name with ‘.au’ at the end of it), requires the owner to provide an ABN / ACN .
Cloud Hosted Network
Your website will be securely stored on one of our partner-host servers. You will be provided with login credentials to access your hosting account online. All hosting servers are supplied and maintained by our partner provider(s) and at times, we may need to direct you to their support team(s) as necessary.
It is highly recommended that you register for an email account that contains your domain name, such as ‘email@example.com’.
Eye Dropper Designs can create your email account(s) at an additional yearly cost. This is not included in the standard pricing for the Basic Website Package.
You will be invoiced automatically approximately 4 weeks prior to your email account renewal date. If your invoice is not paid, your email account(s) will not be renewed and will be removed from the server. Eye Dropper Designs will not be held accountable for any loss of data or interruption to business as a result.
*Note – Eye Dropper Designs are not responsible for ensuring back-ups of your email accounts. You must ensure you take provisions to regularly back-up your email accounts on your own external device (either through cloud storage or on a physical hard-drive).
An SSL certificate is an encryption service added to your website – mostly used to ensure safe financial transactions. Give your customers peace of mind when making payments through your website.
A Standard SSL Certificates is highly recommended and can be added to your package at an additional cost. This is not included in the standard pricing for the Basic Website Package.
You will be invoiced automatically approximately 4 weeks prior to your SSL Certificate renewal date. If your invoice is not paid, your security certificate will not be renewed and will expire. This will result in your website becoming insecure. Eye Dropper Designs will not be held accountable for any loss of data or interruption to business as a result.
Eye Dropper Designs will assist with basic website content creation, based on the information you provide to us. Your basic website will require the following information:
This is information about your business such as the number of years in operation, the story behind your business’ start-up, interesting facts or information about your business, your business’ point of difference, etc.
Products / Services
We require a list of your core products / services, along with a description of each. Where possible, professional photography to represent each product/ service is desirable.
We will use your business contact information on the contact page unless otherwise requested. Your contact page will also have a contact form for users to make online inquiries.
Social Media Accounts
It is recommended that you incorporate/ link your existing social media accounts with your website. Please provide all social media URL’s.
Eye Dropper Designs can assist with Social Media account creation at an additional cost. This is not included in the standard pricing for the Basic Website Package.
Photography & Video
Professional Images & Video Footage
In order to ensure a high quality website, we will only accept professional images to be used in your website. You may supply your own professional images – provided you have copyright permission to use these on your website. It is your responsibility to ensure all content, images and video footage used on your website does not breach any copyright laws.
Eye Dropper Designs can arrange professional photography and video footage of your business / products / services for your website at an additional cost. This is not included in the standard pricing for the Basic Website Package.
Your Logo & Branding
Logo Design – Supplied
A logo is required for the benefit of your business and website branding. You must supply a high resolution copy of your logo to be used on your website.
Logo Design – Created
If you are unable to supply a logo, Eye Dropper Designs will create one for you at an additional cost. This is not included in the standard pricing for the Basic Website Package.
We will design one simple logo only. You can request one change to the logo design. Additional changes will incur additional Graphic Design Fees (see our current Schedule of Fees for pricing).
You are required to advise us of your preferred colour scheme at the time you register for your website. If you do not advise us of a suitable colour scheme, we will do a quick analysis of your target market and design a colour scheme accordingly.
Business Cards & Flyers
Using your logo and pre-determined colour scheme, we will design and print for you a business card and/ or flyers at an additional cost. This is not included in the standard pricing for the Basic Website Package.
Your business cards will include your logo, contact information and core products/ services. You can make one change request to the original design of your business cards/ flyers.
Additional Website Features
You may request to have any additional features for your website, at an additional cost. The following is a list of common features – please note that these are not included in the standard pricing for the Basic Website Package but can be purchased and added to your website at any time.
A page created specifically to meet your marketing needs. Generally this is a page that is integrated with a sign-up or opt-in form, and linked with your preferred email marketing campaign (such as Mailchimp). Landing pages are essentially used as a marketing tool to link your website with other marketing tools (such as social media).
Landing page creation is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Customised Contact Forms
Because one size doesn’t fit everyone. You might need some custom fields on your contact form – some drop down menus or other selection options – maybe even a survey-style form. When you need your clients to provide you with information – you’ll need a customised form.
Customised contact forms are not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Image Gallery / Portfolio
Most businesses these days have a requirement to show off some of their work, products, services or events. We’ll customise a gallery to suit your needs.
Image galleries/ portfolios are not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Put simply – an online store front. Do you have things you want to sell? Then you need E-Commerce. We’ll set you up with a store front that fits in with your websites design and help you to integrate your chosen payment methods. Of course you’ll have access to the stores back-end where you can add and modify your items for sale and track stock and inventory too.
Ecommerce integration is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Membership System Integration
Do you have clients who need to log in to access personal information, or membership benefits? Login Portals can be created and customised for a wide range of purposes and provide an added layer of interaction and customisation within your site, giving your clients a more personal and dedicated experience.
Membership integration is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Mailchimp is an amazing marketing tool that allows you to capture information from your online clients and visitors. We can integrate various forms within your site with Mailchimp to do some pretty amazing things.

Additional Customised Features
Have you got a unique requirement for your website that isn’t listed here? Many people do – as each business is unique in its own right, they need features and functions to match. Talk to us about your business and we’ll work through some ways to make your website stand out from the crowd.
General Data Protection Regulations (GDPR) are now in force within the European Union (EU). It is the responsibility of the Client to ensure their website and content meets all required standards and regulations in line with its users / audience.
Eye Dropper Designs recommends all websites comply with the GDPR, regardless of being located outside of the EU as the regulations may still apply if you have residents within the EU visiting your website. There may be significant fines or fees applied to those website that do not comply.
Please contact us to discuss further or to request GDPR compliance measures to be added to your website. Additional charges may apply.
GDPR Compliance is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Website maintenance is not included with your Basic Website Package. Regular maintenance can be added to your package at an additional cost. It is important to note that the following items are not included in your package:
Site Monitoring & Updates
All sites need updating to ensure they meet the most current online requirements. If your site isn’t updated regularly, you might find that things just don’t work the way they should.
Site monitoring and updates are not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Backups are essential. Losing your website could be like losing your phone, or worse – sometimes there’s information on there, that for one reason or another, just isn’t accessible anywhere else. With daily website backups – you don’t ever have to worry about losing the data and information from your site. It’s also a great fail-safe if your site is ever hacked or destroyed by some unstoppable force.
Website backups are not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
Added Security & Breach Notifications
An extra layer of security to your site can be added by way of maintaining the most updated security patches available. It’s also important to monitor suspicious activity on your site using automated detection tools to try to block suspicious activity before it becomes a problem.
*Note – these methods cannot guarantee that your site will not become subject to security breaches (such as viruses, malware and other hacking or phishing), however we will do our best to prevent these things from occurring.
Added security and breach notifications are not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
A bit like a help-desk – personalised support with your website whenever you need help. As a part of this support – you’ll be provided with one-to-one training on any of the features to do with your site – it’s important that you know how to use one of your most valuable tools.
Ongoing support is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
If you regularly need to update your content or change some images on your site, you can do this by making a change request. Simply get in touch, give us the instructions, and we’ll get it done! Hassle free website updates – we want to make your life as easy as possible. Change requests may include changing wording, content or images on existing pages and modifying any of the elements within your website – such as colours and layouts.
Change requests is not included in the standard pricing for the Basic Website Package but can be added at an additional cost.
TERMS & CONDITIONS:
For all Basic Website Packages, these standard terms and conditions will apply and take/ come into effect at the completion of your registration for the Basic Website Package. By completing your registration, you are agreeing to abide by these terms and conditions. Your registration form, along with these terms and conditions will form your Basic Website Package contract.
The Client and Consultant may disclose confidential information one to the other to facilitate work under this Agreement. Such information shall be so identified in writing at the time of its transmittal, and shall be safeguarded and not disclosed to third parties by the receiving party. Confidential information shall not include information that:
- is already known to the party to which it is disclosed;
- is or becomes part of the public domain without breach of this Agreement;
- is obtained from third parties, which have no obligations to keep confidential to the parties to this Agreement.
Description of Work:
The unique combination of inclusions selected by Client at the time of registration comprises the description of work to be carried out – as per the Glossary of Terms in this document.
For the duration of this contract, or until the Work is completed, the Client will provide full access to Consultant of all relevant accounts and login systems necessary for the Work to be completed, including but not limited to – access to all hosting accounts, existing websites, operational systems and all content for the website.
Client agrees that during this contract term no other website design company will have access to the Clients’ Work, as created by Consultant. If for some reason Client needs to give access for any other reason besides the services as set out by these Terms and Conditions, Consultant will be informed prior to giving access by Client in writing.
Assignment of Work
Consultant reserves the right to assign other designers or subcontractors to the Work to ensure quality and on-time completion.
Permissions and releases:
The Client agrees to indemnify and hold harmless Consultant against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the Work at the request of the Client for which no copyright permission or previous release was requested, or uses which exceed the uses allowed pursuant to a permission or release.
The Client may publish or disclose information regarding the Work and shall acknowledge the support of Consultant in all such publications. The Client will not use the name of Consultant, in any advertising or publicity without the prior written approval from the Consultant. The Consultant will not use the name of Client, in any advertising or publicity without the prior written approval from the Client, with the exception of the Consultant’s business portfolio.
Complete Intellectual Property and Copyright remains in Consultant’s name for the duration of the Work being completed, unless client requests in writing to obtain full copyright and this request is approved in writing by Consultant.
Consultant will provide Client with an opportunity to review the completed website prior to the website being launched ‘live’ on the internet. It is the responsibility of Client to ensure that all content on the website has been checked for errors and to ensure that the content and images used accurately reflect that of the Client and the websites intended use and that no copyright breaches have been made.
Pricing, Payments & Startup:
All Basic Website Packages are required to be paid in full, up-front, unless otherwise agreed upon in writing by both the Client and Eye Dropper Designs. Eye Dropper Designs will not commence any work/ services until payment has been received in full.
The Basic Website Package is not available on a monthly plan.
All payments made are non-refundable.
For some products services, recurring fees will apply (for example but not limited to, where domain names and web hosting need to be renewed on a regular schedule). You will be automatically billed/ invoiced for these costs approximately one month before the expiry/ renewal date of each product/ service.
Failure to pay fees or invoices by the due date may result in the cancellation of services and deletion of all data, files and information from corresponding to your website without notice. Unavoidable interruptions may also occur. Eye Dropper Designs will not be held accountable for the loss of data or interruptions caused as a result of unpaid fees or invoices.
Termination of any ongoing products/ services must be made in writing with at least 4 weeks prior notice (see Termination & Exit Fees below).
All ongoing fees are non-negotiable and non-refundable.
Termination & Exit Fees
Eye Dropper Designs has the right to terminate any ongoing products/ services. You will be notified in writing to your designated email and/ or postal address with at least 30 days notice prior to termination coming into effect. After termination, all services will cease in-line with the details of your termination notice.
If the client wishes to Terminate any ongoing products/ services, a request to terminate must be received in writing with at least 30 days notice.
All affected products/ services will be removed from our servers after 30 days of being notified of the termination. No further costs will apply.
Important Note: Your website can not be retrieved once termination has occurred.
All fees are non-refundable.

Please note that not all inclusions are provided in the standard pricing and may incur additional costs.
